The participation of foreign representatives of small business does not hurt to carry a small company

In public discussion of the draft amendments submitted by several regulations, including the Law 209-FZ "On the development of small and medium enterprises in the Russian Federation."
Currently, one of the conditions for inclusion hozobschestv to small and medium-sized enterprises (SMEs) is a criterion for shares in the authorized capital of LLC. In particular, the total share of foreign legal entities and (or) legal entities which are not SMEs, should not exceed 49%. The latter restriction does not apply to the Company related to IT, or Skolkovo is a subsidiary organization of the government of the list of supporting the field of innovation.
The project is proposed to add that the limitation on the total share of foreign legal entities and does not apply to the company, founded by foreign legal entities that have business income for the preceding calendar year does not exceed the limits set by the Russian government for each category of SMEs, and average number of employees for the preceding calendar year corresponds to the limits for SMEs.
Details of such foreign legal entity shall be to provide the tax authorities of the CCI, which is necessary for doing SMEs registry.
