The law on clearing activities was adopted by the State Duma

Deputies of the lower house of parliament adopted in the third final reading the law "On Amendments to the Federal Law" On Clearing, Clearing Activities and the Central Counterparty "and certain legislative acts of the Russian Federation."
The law introduces a legal mechanism similar to that of the special trading bank account of the clearing participant, according to which, on the one hand, the client's property is weaned from the clearing participant's property, on the other, the property of the clearing participant's client located on such a special account can not be drawn Collection of obligations of the clearing participant.
The central counterparty, according to the document, is empowered to resolve possible problem situations at the risk of default not only of the clearing participants, but also of their clients, i.e. At an earlier stage than is provided for by current legislation.
The provisions of the draft law are aimed at the further development of the organized commodity market and concerns the improvement of the regulation of the activities of the commodity delivery operator, taking into account the storage and transportation of certain types of goods, as well as the possibility of combining the functions of the central counterparty and the commodity supply operator.
