The Supreme Court of the Russian Federation confirmed the duty of drivers to pay for the repair of the on-board devices "Platon", RIA Novosti correspondent reports from the courtroom.

Thus, the court dismissed the lawsuit filed by ZAO Stavropolsky Broiler, which asked that the terms of the gratuitous use of the on-board device be illegal, which determines that if any part of the on-board device kit, including the equipment passport, is lost, the borrower is obliged to reimburse its cost in full - 6822 rubles 98 Kopecks.

The plaintiff believes that such unilateral imposed conditions contradict the norms of the Civil Code of the Russian Federation and are burdensome.

According to the representative of the company, he also appealed to the management of the Federal Antimonopoly Service and the arbitration court with the question of the legality of the amount of compensation. "The antimonopoly body has already considered the contractual condition of the abuse, the decision of the arbitration court on the suit to amend the agreement has not yet been made," said Nikolai Sorokin.

The defendant in the case was the Ministry of Transport of the Russian Federation, who asked to dismiss the claim. In objections, the agency indicated that the operator was entitled to determine the content of the contract for the unrestricted use of airborne devices in accordance with a government decree.

"The terms of the contract can not be arbitrary and tied to the provisions of the rules of charging, while the plaintiff did not actually incur losses, speaking only of the risk of their occurrence," the Ministry said.

The court upheld his position. On Wednesday, the judge read only the operative part of the decree, so the motives for adopting such a decision are as yet unknown.
